According to Article 275 of the Criminal Law, if intentionally destroys public and private property, the amount is large or there are other serious circumstances, the person shall be sentenced to fixed-term imprisonment of not more than three years, detention or fine; if the amount is huge or there are other particularly serious circumstances, the person shall be sentenced to fixed-term imprisonment of not more than three years but not more than seven years.
In judicial practice, if a loss of public and private property is generally caused by more than 5,000 yuan, it will be considered as a large amount and can be filed and prosecuted in accordance with the law. However, it should be noted that there may be differences in the recognition standards for “large amounts” in various places, and the specific requirements need to be referred to local judicial interpretations and relevant regulations.
In addition, regardless of whether it constitutes a crime or not, the car owner has the right to ask the scratched party to compensate for the losses such as car maintenance costs. If the vehicle depreciates due to scratches, after the depreciation amount is determined by professional evaluation, the scratched party shall also bear the corresponding compensation liability. The evaluation of the vehicle depreciation part needs to be carried out by more professional institutions to ensure the fairness and objectivity of the evaluation.
